Terms and Conditions

Effective Date: January 1, 2025
1. Annual Agreement and Statement of Authorization

• By agreeing to these Terms and Conditions, you (the “Client”) authorize Send Me a Pro (“SMAP”) to proceed with the below-referenced services purchased at the client address provided. This agreement outlines the terms for the services you have selected under the specified plans.

2. Plan Details
2.1 Basic Plan

• Annual membership fee: $99 per year, automatically renewed on the anniversary date of purchase.
• No service is included in this plan; services requested require a separate agreement.

2.2 Quarterly Plan

• This plan includes four visits per year, one visit per quarter, each lasting up to 4 hours.
• If the service visit exceeds 4 hours, additional charges will apply at the hourly rate of your plan.
• Payment options starting from:
  • Pay in full: $2,388 annually.
  • Pay quarterly: $747 per quarter.
• The plan is auto-renewed, and payment must be completed before your scheduled service.
• If additional hours are needed, we will provide a custom quote, which will become your new contract price.
• Any additional a la carte services will be invoiced separately.

2.3 Monthly Plan

• Includes 12 visits, one per month, with each visit consisting of up to 2 hours of scheduled maintenance.
• If the service visit exceeds 2 hours, additional charges will apply at the hourly rate of your plan.
• Includes up to 2 credit hours of extra handyman work each month.
  • If paid in full, you can use the 24 credit hours at any time during the year.
  • If paying monthly, you can only use the credit hours accumulated each month, which expire at the end of the 12-month period.
• Payment options starting from:
  • Pay in full: $4,788 annually.
  • Pay monthly: $399/month.
• The plan is auto-renewed, and payment must be completed before your scheduled service.
• If additional hours are required, a custom price will be quoted, which will become the new contract price.
• Any additional a la carte services will be invoiced separately.
  

3. Service Start Date and End Date

• The service start date will be the date of the first scheduled and confirmed visit.
• The service end date will be the earlier of the one-year anniversary of the agreement or when the scheduled visits have been completed.

4. Annual Commitment

• These are annual contracts. Even if paying in installments, the full annual amount is due, and no cancellations or refunds are permitted. You are committing to a full year of service.
• The contract will automatically renew for successive periods of the same duration unless you provide a 30-day notice before the renewal.

5. Non-Solicitation Clause

• During the term of this agreement and for one (1) year following termination, the Client agrees not to hire any contractors or employees used or recommended by SMAP during the term of this agreement.

6. Materials and Expenses

• SMAP may incur costs for materials during the course of servicing your home. You agree to cover up to $100 in material expenses, plus a 3% materials handling fee.
• No additional materials will be purchased or charges incurred without prior approval from the Client.

7. Payment Terms and Late Fees

• Payments for services are due before the scheduled visit.
• Payments not received by the due date will be subject to a 1.5% monthly service charge on the outstanding balance.
• If payment is not received and the account is referred for collection, the Client will be responsible for all collection costs, including attorney fees.

8. Service Guarantees

• The Client understands and agrees that any maintenance work performed by SMAP is covered by a warranty for a period of three (3) months from the date of completion. If the Client is dissatisfied with the services provided, the Client must notify SMAP in writing within fifteen (15) business days following the completion of the work. Failure to notify SMAP within this period will result in the Client forfeiting their right to any adjustments or claims for warranty. Furthermore, the Client waives any claim for adjustments or damages related to the work if no damage is identified within three (3) months of the service date.
• All labor for additional handyman work that is part of the “credit” hours of the monthly plan has a one-year guarantee. If not fully satisfied, SMAP will repair any defects in workmanship free of charge.
• This guarantee is for labor only and does not cover materials, wear and tear, or damage caused by “acts of God” or changes in client preferences.
• The guarantee is not transferable.

9. Responsibility for Property Damage

• SMAP is not liable for damage to property or equipment caused by wear and tear during servicing.
• SMAP is also not responsible for malfunctioning smoke or carbon monoxide detectors.
• SMAP will not be responsible for failure to follow advice regarding operation, maintenance, or repair.

10. Refunds and Termination

• In the event of a sale of the property, the Client may terminate the agreement with 30 days’ written notice after the date of sale. The Client will only be liable for pro-rated charges up to the termination date.
• No refunds are provided for services rendered prior to termination, and any amounts due must be paid within 10 days after termination.

11. Jurisdiction

• The Client agrees that jurisdiction for the resolution of any disputes related to this Agreement or the services provided will be in the state in which the Client resides, unless otherwise notified in writing by SMAP.

12. Modifications

• SMAP reserves the right to modify the terms and conditions of this agreement as needed. Any modifications will be communicated, and by continuing to use the services, the Client agrees to the updated terms.
